The Speedy Bear PC Repair Company Terms and Conditions

Welcome to the The Speedy Bear PC Repair Company’s Terms and Conditions agreement. For purposes of this agreement, “Site” refers to the Company’s website, which can be accessed at https://www.thespeedybear.com. “Service” refers to the Company’s services accessed via the Site, in which users can order a computer system deep clean and system restore or the purchase and installation of a new computer system to agreed specifications.

The following Terms and Conditions apply when you view or use the Service.

Please review the following terms carefully. By accessing or using the Service, you signify your agreement to these Terms of Use. If you do not agree to be bound by these Terms and Conditions in their entirety, you may not access or use the Service.  

By accessing our Site or our Service, you accept our Privacy Policy and Terms of Use (found here: https://www.thespeedybear.com/terms), and you consent to our collection, storage, use and disclosure of your Personal Information as described in this Privacy Policy.

The following terms are applicable in these Terms and Conditions;

  • “We,” “us,” and “our” refer to the Company.

  • “You” or “your” refers to you, as a user of our Site or our Service. 

  • “Company” and “The company” refer to The Speedy Bear PC Repair Company.

  • “Representative” refers to any person or persons acting on behalf of you, your organisation, your residence or your agreed collection or delivery premises.

  • “Cash” refers to any money in the form of banknotes or coins.

  • “Item” or “items” refers to your computer, laptop, tablet and any associated peripheral devices included keyboard, mouse, monitor, speakers, external devices and all cables

  • “Data” refers to any digital file, program, software solution, settings or cloud system owned by the customer.

  • “New parts” or “parts” refers to addition hardware components, software programs or peripherals required to complete your order in accordance with the specifications agreed by your verbally or in writing.

  • “Acceptance” or “Accept” refers to the moment where you take delivery of your item at your agreed residence or premises.

I. GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms and Conditions.

II. PRIVACY POLICY

The Company respects the privacy of its Service users. Please refer to the Company’s Privacy Policy (found here: https://www.thespeedybear.com/privacy) which explains how we collect, use, and disclose information that pertains to your privacy. When you access or use the Service, you signify your agreement to the Privacy Policy as well as these Terms and Conditions.

III. ABOUT THE SERVICE

The Service allows you to Order a computer system deep clean and system restore or the purchase and installation of a new computer system to agreed specifications.  

IV. REGISTRATION; RULES FOR USER CONDUCT AND USE OF THE SERVICE

You need to be at least 16 years old and a resident of the United Kingdom use the Service.

The Company will not be responsible for any liabilities, losses, or damages arising out of the unauthorised use of your computer, peripheral devices, monitors or digital assets including personal or business files and settings.

V. BACKUP, RECOVERY OF DATA

We recommend that you backup your own data before any item is given to us. We offer a data back-up and cleaning service however we are not responsible for loss of data while your item is within our premises or vehicles. We will not be held responsible for any loss of data or software due to unexpected system failure due to hardware or software failure.

You are solely responsible for backup, control and safety of their own data.

VI. COLLECTION AND DELIVERY SERVICES

The Company operates a collection and delivery service within a 15-mile radius of its trading premises. We reserve the right to amend, restrict or withdraw its Collection and Delivery Service without prior notice or justification.

Where a customer has made an arrangement for a collection or delivery slot with us and you, or a representative of you or your organisation is;

a) not present with the agreed item OR,

b) not present at the agreed premises OR,

c) not at the agreed time and date upon arrival of a company representative then,

The company reserves the right to cancel the order or agreement with the customer and a refund of 80% of any payments made. A 20% transit fee is deducted to cover expected transportation and insurance costs.

VII. 24 HOUR DELIVERY AND COLLECTION WINDOW

The company is under no obligation to return your item within 24 hours from the time of collection and reserves the right to cancel, extend or amend the 24-hour service window under the following circumstances;

a) Heavy traffic, roadworks, major diversions and unexpected road incidents or blockages

b) Environmental factors including but not limited to heavy rain, flooding, icing, storm conditions within a 15-mile radius of the customers’ premises.

c) Unexpected company vehicle failure.

d) Unexpected company employee sickness or ill.

e) Non-availability due to confirmation or suspicion of company member illness where the risk of transmission of illness is high.

f) Non-availability due to confirmation or suspicion of company member exposure to COVID-19.

If you wish to have new parts included within your order or added to your item, then the 24 Hour Delivery and Collection Window will be voided and a new time for delivery will be agreed with you depending on the availability of new parts and their delivery time to the company’s premises.

VIII. UNCLAIMED ITEMS

Once your item has been repaired or has been declared irreparable or we are awaiting a response from you regarding your item, it must be returned to you within 30 days. If the customer fails to collect or neglects to adhere to the terms stipulated in Section 6 or 7 of these Terms and Conditions then you will lose ownership of the said item. We reserve the right to dispose, amend, change or sell the item for its own purposes.

IX. QUOTATIONS

Where a customer requires a quotation, it must be accepted within 5 working days of being quoted. For customer’s whose items are at The Speedy Bear PC Repair Company premises, they may email, telephone, text or post to express your intimate instructions.

X. PAYMENT

The company accepts payments by cash, bank transfer, debit cards, credit cards and invoice. The company reserves the right to ask for full or part payment prior to work being commenced.

Cash Payments:

Cash payments must be made upon delivery and acceptance of the item at the agreed place of collection. Failure to produce payment under these circumstances will result in the item being retained by The Speedy Bear Company until payment is received from any of the accepted payment methods as mentioned above. If we are required to complete additional journeys to the customer return address due to failure to produce payment, we reserve the right to add a £25 delivery fee to the outstanding amount for each additional journey to the customers’ address.

The company also reserves the right not to complete additional journeys to the customers address and will express via email that the customer must come to the company’s treading premises to collect the item. Items will be held for 60 days; upon which time the item will be classed as “Unclaimed Item” and the customer will lose ownership of the item.

Online Payments:

Online payment must be received prior to return/collection. Where a customer has received a repaired item in good faith, but payment has not been made, that payment is due in 14 days of the invoice date.

Should payment not be received on the due date, a cheque not honoured or an online payment not received or is reversed, then we will charge interest as detailed in the Late Payment of Commercial Debts (Interest) Act 1998 as amended and supplemented by the Late Payment of Commercial Debt Regulations 2002 which allows interest to be charged at 8% over the bank of England Base rate and allows recovery of other expenses.

Any item received for repair remains the property of The Speedy Bear PC Repair Company until the invoice amount is paid in full within the maximum period of 60 days. If the invoice is still not paid, then the customer will lose ownership of the item and the item will be classed as an

“Unclaimed Item”.

New Parts:

We offer recommendations of new parts to improve the functionality of your machine. You are responsible to pay us for the cost of acquiring and installation of new parts at no additional cost above the purchase and delivery cost of said new parts. You must pay for additional parts upon acceptance of your item. We are not responsible for the failure of any part where there is a manufacturers warranty or guarantee.

XI. GUARANTEE

The Speedy Bear PC Repair Company offers a 1 year guarantee (unless stated otherwise) on computers and laptops which have received the Deep Clean and System Scrubbing Service and 1 year guarantee on new build computers.

New parts:

If new parts are required to complete your order, we will order them and include them within the service package. At this point the 24 Hour Collection and Delivery window will be voided and a new time for delivery will be agreed with you directly. You will be expected to pay for additional parts before you accept your item.

Any new part with a manufactures or sellers guarantee or warranty will supersede that of the company’s guarantee.

In the event a guarantee return where no parts have been purchased, we will do our best to repair it. However if a guarantee repair requires new parts, you will be liable for the cost of new parts including delivery. If you do not wish to pay for parts we will return the item without repair to you and no refund of the original repair will apply.

XII. LIABILITY

We accept no liability in respect of any problem(s) with your item. This includes, but is not limited to the age, specification or condition of the your item.

Under no circumstances shall we be liable, either in contract, or order, to you, your organisation, your representatives employees or  agents, or any third party, for any injury or damages, including without limitation, any direct, indirect, special or consequential damages, expenses, costs, profits, lost savings or earnings, interruption to business activity, lost or corrupted data, or other liability arising out of, or related to the services provided by The Speedy Bear PC Repair Company, or out of the installation, de-installation, use of, or inability to use the your item, computer system, hardware, software or peripherals. The customer will, upon demand, indemnify The Speedy Bear PC Repair Company in respect of any loss, damage or injury arising from the provision of the services. For the avoidance of doubt The Speedy Bear PC Repair Company has no liability for customer data lost, or damage incurred in any circumstances whatsoever.

XIII. PROMOTIONS

The Speedy Bear PC Repair Company withholds the right to withdraw any and all special offers, discount schemes and promotions without prior notification or reason.

XIV. ONLINE ORDERING

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependants to use this site. 
You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). 
You must not transmit any worms or viruses or any code of a destructive nature. 
A breach or violation of any of the Terms will result in an immediate termination of our service to you or your organisation will retention of any payments made in advance and the additional application of a £10,000 damages to company property fee.

XV. ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.
This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

XVI. MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

XVII. VALUE ADDED TAX

We do not charge Value Added Tax (VAT) on any of our service as effective from the date of these terms and conditions.

VAT ON PRE OWNED ITEMS:

Unless otherwise stated all pre-owned ( second hand ) items for sale on this site are sold under the Global Accounting VAT Margin scheme ( https://www.gov.uk/vat-margin-schemes ). Therefore VAT registered entities will not be able to reclaim any input tax from purchasing these items as no VAT is included on sales of second hand items on this site.

XVIII. PRODUCTS OR SERVICES (if applicable)

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy. 
We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any colour will be accurate. 
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. 
We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

XIX. ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel orders purchased per person, per residence or per organisation. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You are solely responsible for the input and control of your personal payment and address information. Incorrect address information may result in a late fee or none appearance fee being applied in the event of us, or a third party representative of our company arriving at an incorrect address due to incorrect input of your details.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

ANNEX A. DONATION SCHEME

We are under no legal obligation to accept any donation of a computer, laptop, tablet or peripheral device from private or commercial entities. All donations are shall be received in good faith and donators agree that their donations will be examined, cleaner and refurbished for future use. Donations may be used as spares, parts or destroyed without prior notice or exception. 

We cannot be held legally responsible for any damaged incurred once donations have been passed to a local school or education institution. Schools are responsible for the acceptance of donations from The Speedy Bear PC Repair company and their intended use. 

We are not responsible for any maintenance or repair of any device donated from The Speedy Bear PC Repair Company after the date of receipt.

Registration to the Computers for Kids campaign does not automatically qualify any school to receive donations from us.

The Speedy Bear PC Repair Company Returns and Cancellation Policy

III. NEW BUILD COMPUTER

We offer a 30 day return policy for all new build computers still in good working order and with no faults or issues. If any component or item is faulty due to the company’s actions then said item can be returned for a full refund.

 

Any and all new build PCs, items, components and/or peripherals which have been damaged by the customer, accidental or otherwise, the company reserves the right to;

a) refuse to offer a refund

b) offer a refund for 25% of the order price in exchange for the all items sold at the time of purchase.

Refunds may take up to 30 days to process.

IV. CANCELLATIONS

You can cancel your order anytime after submitting an order through the online order system or by phone. If you wish to cancel an order while we are en-route to your premises for collection then you will be subject to a £25 transit fee, deducted from your initial payment.

Personal Information includes your email, name, address, phone number and payment details such as credit/debit card information PayPal details or bank account information which you submit to us through the registration and/or order process at the Site.

Information collected via Technology:

To activate the Service you do not need to submit any Personal Information other than your email address, phone number, name, address and some payment details. To use the Service thereafter, you may need to submit further Personal Information,which may include: login passwords, usernames and other login information. 

Information you provide us by registering for an account:

In addition to the information provided automatically by your browser when you visit the Site, to become a subscriber to the Service you will need to create a personal profile. You can create a profile by registering with the Service and entering your email address, and creating a user name and a password.
